APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE
These conditions regulate the use of the https://equtea.com/ service. Customers who place orders through the website https://equtea.com/ fully accept the General Terms and Conditions, which are described in this General Terms and Conditions section. These conditions are binding for both parties, the company and the consumer.
These conditions may be modified without prior notice, and those published at the time the service is used shall prevail.
Please read these Terms carefully before using this website. By using this website or placing an order through this website, you agree to be bound by these Terms and, if you do not agree to all of the Terms, you must not use this website.
APPLICABLE LEGISLATION

The information or personal data provided by the customer will be processed in accordance with the provisions of the Privacy Policy. By using this website, the customer consents to the processing of such information and data and declares that all information or data provided is true and corresponds to reality.
USE OF THE WEBSITE
By using this website and/or placing orders through this website, the customer undertakes to:

Do not place any false or fraudulent orders. If it could reasonably be considered that such an order has been placed, Equtea may cancel it and inform the relevant authorities.

If the customer does not provide all the information Equtea requires, the order cannot be processed.
SERVICE AVAILABILITY
The items offered through this website are only available for management in mainland Spain.
No contract shall exist between the customer and Equtea in relation to any product until the order has been expressly accepted by Equtea. If the customer's order is not accepted and any charge has already been made to your account, the amount thereof will be refunded in full.
To place an order, the customer will follow the steps of the online purchase procedure and click on "Authorise payment". After this, they will receive an e-mail confirming receipt of their order (the "Order Confirmation"). This does not imply that the order has been accepted, since all orders are subject to prior acceptance by Equtea, of which the customer will be informed through an email confirming that the product is being shipped ("Shipping Confirmation").
LEGAL WARRANTY
All articles offered on https://equtea.com/ are covered by a legal guarantee.
PRODUCT AVAILABILITY
The items visible on the website are only available as long as they are in stock. In the event that a purchased item is out of stock, Equtea reserves the right to provide you with information about substitute products.
If the customer does not wish to place a replacement order, he may request a refund of the sums paid at no cost to the latter.
PRICE OF PRODUCTS
The price of each product will be the price stipulated at all times on https://equtea.com/, except in the case of manifest error. Errors may occur in the prices. If the administrators of Equtea discover an error in the price of any of the products that the customer has ordered, either the price in the file of the property or a price error due to programming at the time of processing, the customer will be informed as soon as possible and will be offered the option to reconfirm your order at the correct price or cancel it. In the event that the customer cannot be contacted, the order will be considered cancelled and the amounts paid by the customer will be refunded in full.
Equtea reserves the right to change its prices at any time. In the event of a price change, the properties will be invoiced at the price valid at the time the order was placed.
VALUE-ADDED TAX
In accordance with the provisions of article 68 of Law 37/1992 of 28 December 1992 on Value Added Tax, the supply of the articles shall be understood to be located in the territory where Spanish VAT is applicable. The applicable VAT rate will be that legally in force at any given time depending on the specific article in question.
HOW TO BUY
The client can make his purchase by placing the cursor over the photograph of any property and clicking on the option "Buy" or on the icon of the basket or purchase once he has opened the file of any product where he can see detailed information of that product by clicking on the option "Add to basket". If you wish to continue shopping, simply exit the page and look for any other property you desire. If you wish to finalize your purchase, choose the option "Process Order" which will take you to the Shopping Cart.
Once in the shopping basket, the total cost of the chosen products and the associated management fees are displayed. If you wish to add more products to the shopping basket, simply use the option "Continue Shopping" and once you have added all the desired products to the basket, click on "Continue".
In the case of registered users, they only have to enter their email and password in the "I am already a user" section and click on the "Sign in" button, and in the case of new users, they must choose the other option and fill in the requested fields, accept the Privacy Policy and click on the "Send" button.
Click on "Process Order" and on the next screen you will see the order summary, the shipping information with delivery times and choose the desired payment option: credit card or bank transfer. On this same screen we can modify the invoicing details and add new addresses. Click on the button to accept the Conditions of Sale and then click on "Finalise Purchase". The user will receive an e-mail with all the details of the order.
Equtea will send an email to your email with the order details so that the customer can check that all data are correct. We recommend the customer to check that the shipping and billing information is correct to avoid problems and delays in delivery. If your email address is Hotmail, Yahoo, Terra, Gmail, etc. this message may arrive in "Junk Mail" or "Spam". The customer should check these folders if the confirmation email takes a long time to be received. Equtea should also be included in the list of safe senders.
REFUSAL TO PROCESS AN ORDER
Equtea reserves the right to remove any property from the website at any time and to remove or modify any material or content thereof. Exceptional circumstances may occur that require a refusal to process any order after the Order Confirmation has been sent, so Equtea reserves the right to do so at any time, at its sole discretion.
Equtea is not liable to the customer or any third party for removing any property from the website, regardless of whether the property has been sold or not, removing or modifying any material or content of the website, or for refusing to process an order once the Order Confirmation has been sent.
PAYMENT METHODS
Equtea offers the following payment methods:
Equtea: Payment by transfer will not involve any additional charge on the order placed in Equtea, but may involve extra charges that will be borne by the person making the transfer. The shipment will be made upon receipt of the payment in the account of Equtea. With this form of payment, the shipment of the order may be delayed by 1 or 2 days until the payment is validated. If within three days Equtea has no record of the transfer, we will proceed with the cancellation of the order. The transfer will be made to the account that appears at the time of purchase. In this transfer must state: The name of the person placing the order and in the concept, the order number.
TRANSFER OF RISK AND OWNERSHIP OF PRODUCTS
The risks of the real estate purchased are borne by the client from the moment of delivery.
The customer acquires ownership of the real estate when Equtea receives full payment of all amounts due in relation to the real estate, including management fees.
INTELLECTUAL PROPERTY
The customer acknowledges and agrees that all copyright, trademark and other intellectual property rights on the materials or content provided as part of https://equtea.com/ correspond at all times to Equtea or those who licensed it for use. The customer may make use of such material only in the manner expressly authorized by Equtea or those who have licensed it for use. This does not prevent you from using this website to the extent necessary to copy information about your order or Contact details.
VIRUSES, HACKING AND OTHER COMPUTER ATTACKS
The customer shall not misuse this website by knowingly introducing viruses, Trojan horses, worms, logic bombs or any other technologically harmful or deleterious programs or material onto this website. The customer shall not attempt to gain unauthorised access to this website, the server on which this website is hosted or any server, computer or database related to this website. The customer agrees not to attack this website via a denial of service attack or a distributed denial of service attack.
Failure to comply with this clause could lead to the commission of offenses defined by the applicable regulations. Equtea reports any breach of such regulations to the competent authorities and cooperates with them to discover the identity of the attacker. Also, in case of a breach of this clause, you will immediately cease to be authorized to use this website.
Equtea shall not be liable for any loss or damage resulting from a denial-of-service attack, viruses, or any other technologically harmful or deleterious programs or materials that may affect your computer, computer equipment, data, or materials as a result of using this website or downloading content from it or to which it redirects.
WRITTEN COMMUNICATIONS
Applicable regulations require that some of the information or communications that Equtea sends you are in writing. By using this website, the customer agrees that most of these communications with us are electronic. Equtea will contact the customer by e-mail or provide information by posting notices on this website. For contractual purposes, the customer consents to use this electronic means of communication and acknowledges that any contract, notice, information and other communications that Equtea send you electronically comply with legal requirements to be in writing. This condition does not affect their rights under the law.
NOTIFICATIONS
Notifications sent by the customer should preferably be sent through our contact form. In accordance with the provisions of the preceding clause and unless otherwise stipulated, Equtea may send communications either by e-mail or to the postal address provided by the customer when placing an order.
Notifications will be deemed to have been received and properly made the instant they are posted on our website, 24 hours after an e-mail has been sent, or three days after the postmark date of any letter.
TRANSFER OF RIGHTS AND OBLIGATIONS
The Agreement is binding on both the customer and Equtea, as well as our respective successors, assigns and assignees.
The Customer may not transfer, assign, record, or otherwise transfer a Contract or any of the rights or obligations arising therefrom in its favor or to the Customer, without having obtained the prior written consent of Equtea.
Equtea may transfer, assign, encumber, subcontract, or otherwise transfer a Contract or any of the rights or obligations under it in our favor or to us, at any time during the term of the Contract. For the avoidance of doubt, such assignments, assignments, encumbrances, or other transfers shall not affect the rights, if any, the customer has as consumers recognized by law or cancel, reduce, or otherwise limit the guarantees both express and implied, we could have granted.
EVENTS BEYOND OUR CONTROL
Equtea shall not be liable for any failure or delay in the performance of any of our obligations under a Contract caused by events beyond our reasonable control ("Force Majeure Cause").
Force Majeure shall include any act, event, default, omission or accident beyond our reasonable control, including but not limited to the following:
Strikes, lockouts or other industrial action.
Civil commotion, riot, invasion, terrorist attack or terrorist threat, war (declared or undeclared) or threat or preparation for war.
Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
Inability to use trains, ships, planes, motor transport or other means of transport, public or private.
Inability to use public or private telecommunications systems.
Acts, decrees, legislation, regulations or restrictions of any government or public authority.
Strike, failure, or accidents in maritime or inland waterway transport, postal, or any other type of transport.
Our obligations under the Contracts shall be deemed to be suspended for the period during which the Force Majeure Event continues, and we shall have an extension of time to perform such obligations for a while equal to the duration of the Force Majeure Event. We will use all reasonable endeavors to bring the Force Majeure Event to an end or to find a solution that will enable us to perform our obligations under the Contract despite the Force Majeure Event.
RESIGNATION
The failure of Equtea to require strict compliance by you with any of the obligations assumed by you under a Contract or these Conditions or the failure by us to exercise any rights or remedies to which we may be entitled under such Contract or these Conditions shall not constitute a waiver or limitation of any such rights or remedies and shall not relieve the customer from complying with such obligations.
No waiver by us of any particular right or remedy shall constitute a waiver of any other right or remedy under the Contract or the Conditions.
No waiver by us of any of these Conditions or of any rights or remedies under the Contract shall be effective unless it is expressly stated to be a waiver and formalised and communicated to you in writing in accordance with the Notice section above.
PARTIAL NULLITY
If any of these Conditions or any provision of a Contract is declared null and void by a final decision of a competent authority, the remaining terms and conditions shall remain in force and shall not be affected by such declaration of nullity.
RIGHT OF INURE HOME SHOP TO MODIFY THESE CONDITIONS
Equtea has the right to revise and modify these Conditions at any time.
The customer will be subject to the policies and conditions in force at the time you use this website or place each order, unless by law or decision of government agencies, Equtea must make changes retroactively in such policies, conditions, or Privacy Statement, in which case, any changes will also affect orders you had previously made.
APPLICABLE LAW AND JURISDICTION
The use of our website and contracts for the purchase of products through this website shall be governed by Spanish law.
Any dispute arising out of or in connection with the use of the website or such contracts shall be subject to the non-exclusive jurisdiction of the Spanish courts and tribunals.
If the customer is contracting as a consumer, nothing in this clause shall affect the customer's rights as a consumer under current legislation.
The European Commission provides an online dispute resolution platform which is available at the following link: http://ec.europa.eu/consumers/odr/. Consumers will be able to submit their complaints through the online dispute resolution platform.

SHIPMENTS AND DELIVERY TIMES
At Equtea we prepare all orders with the utmost care. "The satisfaction of our customers is our priority".
Shipments will be made with a transport company. Delivery times will vary depending on the destination and the service selected. In any case, for various reasons, the shipment may be delayed.
In all cases, delivery charges are calculated on the basis of weight and volume and will be determined when the order is accepted.
Orders will be delivered to the delivery address designated by the customer. If the delivery address is incorrect, it is not possible to change it once the shipment has been made. If you detect any incorrect information, please contact us as soon as possible to arrange it with the transport company.

ORDER PREPARATION
Orders placed before 14:00h on a working day will be shipped the same day by transport. Any order placed on Friday from 13:00h to Sunday will be processed on Monday.
Once the order has been placed on the website it is important to pay attention to the e-mail, as it will inform you of the status of your order. Immediately after you have made your order, an e-mail will be sent to confirm your order and the order will start to be dispatched.
*If the product is not available in stock, the user will be contacted by telephone or e-mail to inform of the new approximate delivery time, or to suggest an alternative to the desired product; in case of disagreement, the amount will be refunded immediately.
CANCELLATION
The user will have a period of 7 calendar days to cancel the order and return it. This period begins on the day the order is received. The product must be returned in the same condition in which it was delivered, unused, unsealed and in its original packaging. The return or shipping costs will be paid by the user, unless the return is made due to defects in the product.
The refund will be made in the same way in which the payment for the purchase was made.
Before returning an order, you must contact Equtea through our phone number 948415757 or via e-mail info@equtea.com to request a refund. To do this, you must indicate:
- Order number or full name and date of order.
- Products to be returned- Collection address
- Contact telephone number
Once the method of return has been agreed, the following must be taken into account:
- Pack the product or order securely so that it is not lost during transport.
- When the product is handed over to the transport company, remember to ask for the receipt. This is necessary as proof until it arrives back at our warehouse in case the item is lost in transit.
- No returns will be accepted without prior notification.
RETURNS POLICY
If the product arrives defective or wrong.
Once the customer receives the product, if it detects that it is defective or erroneous, you may return it, and in this case EQUTEA will assume the shipping costs generated by the return. We will proceed to send the replaced product, at no additional cost to the customer.
In cases of significant and visible damage to the packaging of the goods during transport, we recommend that you note the incidents on the delivery note of the carrier and notify us at atencioncliente@equtea.com as soon as possible.
Withdrawal
According to current legislation, the right of withdrawal is not applicable to distance selling of food, as these are products whose conservation control is lost at the time of delivery and therefore may expire or deteriorate rapidly (art. 103 paragraph d) of the Consolidated Text by RDL 1/2007.
